so i am told by my father (he has his green card and has had it sense a year or so befor i was born) that his wife/my step mother has the papers to get her green card but she has not sent them in to get the card. now i assume she has had thes papers for at least 11 years (they have been married for 12). also i am told that some imagration agents will look at the papers and let her pass whal some will deport her. so technicealy can she be deported?
she has worked befor so i do not know if that means she has a SS number or not. what do you think.

I have just completed the correct way to get a green card. I have found out that if you are here under false pretenses, and have not applied for your green card, you can be deported.

She should apply as soon as possible. The process will take about a year or so. Once you have started the process you can stay in this country while the process goes on. You can not leave this country unless you have a special parole paper, while your process is being reviewed.

The length of her stay so far maybe a problem. Her working illegally could be a problem also. She has no SS card if she has not applied. She is an illegal at this time as you tell me.

The best bet your father and step mother can do is to hire an attorney, an immigration attorney. AS the red tape is so bad, only an attorney can up her now.

I think there is a good chance they might do their job and send her back to Mexico where she belongs. That would be nice. She probably has a fake social like the rest of them.
