I was in a 35 mph zone when when I saw a 45 mph sign 50 feet ahead. So I accelerate and a police car clocked me at 50 mph, although I thought I was at 45 mph. I wonder if I should fight this ticket or just pay the fine.

The increased speed limit does not begin until after you pass the sign posting the new limit. If you began to accelerate when you saw the sign, before you passed it, you were speeding for that distance until you reached the sign.

If you waited until you passed the sign before accelerating, you were correct. However, if the officer clocked you going 50 in the 45 zone, you were still speeding. Either the officer's radar gun was wrong or your spedometer was. You can attempt to fight the ticket if you believe his radar gun was wrong, but the police department will almost always keep a very good record of when the radar gun was last calibrated, and it is usuallly at least every few days. Some officers even check calibration at the beginning of every shift and record it.

If you were in the wrong by speeding up too soon, or if you were really going 5 over, you should pay. If you truly think you were not speeding, fight it.

Pay it,you dont have a chance. From the president of U.S. to the mayor, they are all against you.Every traffic law that is made is designed to take your money. You hadn't made it to that sign yet, even though there was open road ahead of you, with little are no traffic on it.The judge or nobody else cares about you,are what the conditions were. It's all about money.

I would go to court and fight it. This book has a lot of helpful info on traffic laws and how to fight traffic tickets: http://www.informationsourcebook.com/trafficticketsecrets

If you pay he fine without going to court your insurance will likely go up. If you go to court you could get probation and not have your insurance increase.

It's worth the price of the book to be armed with infromation to help you avoid being found guilty and having to pay increased insurance for 3 years.

Good Luck!

Tom
