How do you find an attorney in Missouri that is knowledgeable and willing to go after a fellow attorney for violations of the FDCPA to the tune of $20K plus?

Attorney for BankOne came at me with civil summons. Immediately sent him Notice to Validate bogus debt. No response;continued on with civil action. Had to get attorney to finally stop their scullduggery; dismissed by Plaintiff wothout pregidous. Now can't find anyone that knows how to go after them for FDCPA violations. Have tried all suggestions. No joy. In Missouri and there is next to nothing in Statutes, law or attorney pool to work with.

Is the attorney acting as a collection agency?

There are several different ways you can look for an attorney.

1. Go to your county court website and look over the cases that lists the attorney you are wanting to sue. Get the names of those who went up against him/her. Try to find one that had gone up against him/her maybe more than once and had also won.

After you get a few names, then look them up to see what their strongest areas are and how often they won.

Research is always time consuming, but the more effort you put into it may pay off.

2. Go to www.naca.net and look for an attorney in your area that specializes in FDCPA cases.

3. Contact your state bar association.

The best way to find an attorney is through word of mouth, an attorney you know may know one that is knowledgable in FDCPA violations. Additionally, look in the yellow pages and your local Bar Association. Your case for whatever reason was dismissed without prejudice, however the plaintiff has the right to sue you again, so be aware. FDCPA regulates collaction activity and attorneys collecting on a debt are subject to the FDCPA. When you contact an attorney, they dont know you, dont act emotional, just give them the facts, answer their questions and they will see if you have a case.
