You would have prove they took the dog and have you notified the police that your dog was stolen? Otherwise it is just your word against theirs. You can sue - you can really sue for anything, but you will lose and they could countersue if there is no merit is found for your case and win.
With your updates - I would say you need the police to investigate. I would have gone to your neighbors and ask them first if they have the dog. A lawsuit would only make sense now if you get the dog back - you have a police report on file - and they continue to take your dog without your permission. Your dog is your property and they have no right to take your car or your tv without your permission than taking your dog. Call the police if they don't answer the door, deny they have to dog and you don't believe it, or you believe they are taking the dog away.

I'm against law suits, but :
Yeah, if the dog is registered, and fully vaccinated by YOU, you can go to small claims court, to get your dog back. And possibly Sue for stolen property.
You can go to a higher court, if you have children, and those children are upset by the disapearance of their dog, and you will recieve higher reparation.
You can sue, if you think they went on your property, to get the dog, you can sue for trespassing.
You should get a warrant, or a restraining order, so they are not allowed near your dog.
If your dog is unregistered, you might have difficulties, unless you ask your vet, for proof the dog is yours, and has been...
Proof, could mean vaccination papers, or a concurent record.
They also might say you gave your dog to them, then request they show proof. If they feel you have been mistreating yoru dog, they can use that against you, again, they need proof that they took the dog TO the vet, to be seen.
They were supose to call animal cruelty line, or a warden, to look into your case, they cant take the law into their own hands.
Also, one of them might have some sort of attatchement to the dog, liek a kid or a depressed adult. They might battle to keep the dog, even if there is no chance of them winning.

On what grounds do you think your going to collect damages for? One you don't have the dog nor are you able to prove they have the dog. Secondly in order to collect damages you must be able to prove the damage actually occurred such as mental distress. Are you seeing a shrink over the loss of your dog? Probably not. Not only that but the cost of the actual case itself would probably be more than the dog is worth unless your talking about an ultra rare fine breeding line that causes the dogs worth to be in the thousands range. Sounds a bit weird to me - I don't know if you can sue, but you may be able to get some form of injunction against them so they are not allowed near your pet if you can show they are a nuisance with taking it - I'd check with a solicitor. Also make sure you have your pet microchipped so they can't turn round and claim she isn't yours. The chip sits under the top layer of skin on the scruff of the neck and has details of the dog and the owners. A vet can scan the chip for the info if your dog is lost/stolen.

I'm not understanding why you are seeking to sue if they have your dog. First, it's a bit frivoulous to sue over something like that, secondly the burden of proof is on you, and you've mentioned you aren't sure if they have her in the house.
Call the police, let them do their job. Secondly, you've mentioned this has happened before, how are they getting your dog? Time to up the security around your place if they can simply take things from your house.

A pox on your neighbors - but is your dog running loose? I don't know about where you live, but where I live there is a leash law. Pets have to be contained [as in fenced] and on a leash when out walking. That doesn't give your neighbors the right to 'kidnap' your dog, but you might have a problem with calling the police.

I would call the police and/or animal control to get your dog back immediately. Be sure to have your records and/or some pictures showing that the dog is yours.
And, yes, I would certainly sue them. Check with a lawyer to see what you could sue them for specificially. They should not be allowed to just kidnap/steal someone's dog without paying a heavy penalty for having done so.

if your neighbors actually have your dog in their house and refuse to give it back, you should call the police. If you live in a large city the police may have an animal unit. Suing, which implies civil court action, would not be the most efficient way to handle it unless you've exhausted all other options.

i would call the police. they will send someone over and if you had a photo of you and your dog, that would be great. that way the police officer can go knock on the neighbors door and maybe make a positive i.d. on the dog. this will get the ball rolling...then you could press charges, then possibly sue for maybe, emotional distress

okay are youreally friendly with your nebighors etc talk party the whole nine yards etc, does your nebighors have pets of there own here or have you visitedd your nebighors with your pet?/ your pet may be attracted too something there thats dragging it back there etc, i doubt your nebighors would just kidnap, your dog, living right there i dont think you can have the heart to sue your nebighors etc, remain, friends, stay calkm, why not tie your poochie up in yard? or give it a fenced in pen etc, anything is posible, be easy on nebighors etc, dont srart a war there as for suing you dont ant thatt!
