For 5 year old child over 40 lbs can back seat belts be used without a child seat?

Depends on the state... most states require at least a booster.. however in cases where the child is big for his age some states make exceptions but require a special harness device that hooks into your seat belt system...

every state has a website... go to yours and find the link to Division of Motor Vehicles and check there... or call the police they can advise you as well.

Rule of Thumb is that if a person is under 4ft 9inches tall...they need a Booster seat regardless of age! Otherwise the shoulder belt rides up into the neck...and that can do really bad things to the head in a wreck...

No. Your kid still needs a booster seat to make certain that the seat belt will restrain him/her correctly.

Of course, your legal obligation to use one depends on your state of residency.
