To collect child support in the future, should i put his name on the baby's birth certificate? i want the last name of the baby to be my last name not his but i'm worried in the future does the baby's last name have to be his to collect child support? He is absent and has no support during this pregnancy even his family.

If he's the father it doesn't matter what your babies last name is.
They go by DNA not last names.

Sorry to hear about your situation. But you do not have to add is name to the birth certificate or to your child to collect child support. From personal experience you can name your child what ever you want first or last name..A little advise would be not to add him to the birth certificate..The courts will place a child support order in effect for you after paternity is established, regardless of your childs name. Also, you recieveing child support does not grant him visitation to the child. He will have to pay the money and ask for it...So again sorry to hear about your problem but try to relax enjoy your pregnancy and come up with a fun name that you feel will suit your child the best.. oh yes i forgot...you can not add his name to the child's birth certificate without him signing what is called an affidavid of parentage at the hospital...I suggest waiting and letting the courts figure it out if he is not being supportive of you..

I don't know what state you are in, laws very from state to state. I live in Tennessee. No, you don't have to have his name on the birth certificate to collect child support. As a matter of fact, if he isn't there to sign, you can't put his name on it. To collect child support, you will have to turn him in to the dept of human services. They will do the collecting. If you are low income, I think they give you a check even. However, when I took my daughters dad to court, they did want me to change her last name. I refused and said let him pay child support for a while and see if he deserves such rights. I was correct, he paid for 4 weeks and I have seen a dime in the 3 years since. It's cool though. My husband treats her as his own and she is actually better off not being around her dead beat dad!

Different rules could apply in different countries..so you need to get some advice. Generally, I think that you should name him as the father on the birth certificate but that it doesn't matter what the name is legally. However, naming (no matter what choice of name you make) can cause issues and difficulties later on in the child's life.

Have you informed the father that he is the father? He has rights too along with the responsibilities. Will he step up and acknowledge the child as his? I would suggest counselling for you and legal advice (go to a legal clinic if you can't afford a lawyer).

My brother had a child, but he and the mother didn't get married. My nephew carries his mother's name and my brother had to pay child support. Just because you have the name of the father on the birth certificate doesn't mean your child has to have his last name. The child wouldn't even have to have your last name either if you wanted. But that's besides the point. The father still has to pay child support. After you go to court of course.

This is how it is in Texas. If you were not married, you can not put his name on the birth certificate. He would have to sign it claiming that he is the childs father. You would need to have a paternity test done to prove he is the father, your word is not enough when it comes to this. If he is the father, child support would be set. Many fathers have underhanded ways of getting out of this though, changing jobs frequently, moving out of state, getting paid under the table. The attorney general in texas helps moms track them down though, but it does take a long time. You need to start the process now though, this way maybe the paternity testing can be done when the baby is still at the hospital. Contact your states attorney general. They help women establish paternity. I know you may be 100% sure it is him, but if you were not married, you will have to prove it. Good luck.

i had this problem when i was pregnant with my son.....i gave him my ex's last name and my ex signed the birth certificate....when i wanted to change his last name to mine they said i couldnt unless my ex signed for the name change too and he wouldnt do it...........so what i would do is give your baby your last name and then have him sign the birth certificate....having him sign it just makes the process of getting child support a little easier bc he had already admited that the baby was his.....if he dont sign it then when you go to get your child support he can sign a paper there and if he dont then a paternity test will need to be done which could take weeks

His name doesn't have to be on the birth certificate for you to get child support. Most likely you will have to get an DNA test.

No your babies DNA just has to match! But I would definitely put his name on the birth certificate as the father and file for support as soon as possible! Get it all legal and you will never have any problems!
