Hi, my 20 year old brother was sworn into the Navy in the spring and is (was?) set to leave for boot camp in November. Last night he was in a drunk driving accident where he was the driver. He hit two other cars (no one was killed), and has lost his license. He is undergoing court proceedings now.

Under what conditions will he still be allowed into his program (nuclear subs)? Does it depend on jail time vs. leniency? Will he be discharged altogether?

chances are, he's toast..UNDERAGED drinking PLUS the DWI charge equals: bad juju.

He will NOT be allowed to swear in while the case is still open, so if November rolls around and he's still on probation or whatever, he will NOT be going to Great Lakes.

he's probably lost Nuke altogether.

The navy at this time is implementing a tougher alcohol related incident program. With this new program, one DUI active duty can be discharged, the Commanding Officer must make this decision based on performance. I think it will be extremely tough for your brother to get in seeing as how he was a minor at the time of the incident and he was driving. In my Navy experience, I would not give him very high hopes. But I could be wrong, he will need to talk to his recruiter and probably an 0-5 or above.

He has seriously damaged himself.

He might or might not be able to pass the human reliability tests to get into his nuclear program. If he has no previous DWI record he might get off with a misdemeanor that would keep him eligible to join the Navy. If he gets a felony conviction he's going to have some very serious problems on his hands.

Best bet is to do two things: Get a good attorney. Get into rehab of some sort. Make a good faith effort to set things right.

But his human reliability and security clearance issues will still be a major challenge.

He was not really sworn into the Navy, He is in the DEP program. As far as a DUI/DWI it hurts you hard. It will be rally hard to make rank. But that is if you get one in the Navy. Not sure if it is b4 the Navy. You most likely can still get in. But why Nuke? Long hours, crappy job. Wearing a TLD all the time... You can get in tho, the Navy has wavers for everything, my bud has a waver for having too many drug wavers. He is in a nuke position also.

HA! papito reported "mister meaner" it is misdemeanor dude. i think of it is enormously uncertain which you would be waiting to get in, yet your terrific wager is to bypass consult with a recruiter. i understand a brilliant sort of the centers have stopped doing "waivers", incredibly ethical ones, precise now because of assembly recruiting quotas for the year so dang early. sturdy good fortune.
