It's a fruit because it's classified as a berry. A tomato is the entire ovary of it's plant and it's entire ovary wall ripens into an edible pericarp. These are distinct characteristics of berries. However, it is also considered as a vegetable because of it's culinary usage, in which, mostly it is served as a meal (usually part of a main course) rather than as a dessert.

And at my house, a tomato is a veggie, because I sure wouldn't want to throw an orange or a peach into a beef soup !
