The reason is the vegetable has seeds which makes it a fruit. That's why tomato is considered a fruit and not a vegetable.

Technically the tomato is a fruit, although it is commonly considered a vegetable because of its uses.
When the Spanish explorers brought back seed from South America, the plant was grown merely for ornament; it was known as the love apple. Though the fruit was described as a salad ingredient before 1600, it was commonly regarded as poisonous, and only within the last century has it become recognized as a valuable food. Indeed, all parts of the plant but the fruit are toxic. It was reintroduced to the United States as a food plant c.1800 and now ranks third among our vegetable crops.

Tomatoes have always been considered a fruit until awhile back when the supreme courts ruled that tomatoes can be considered a vegetable and subject to taxes... as vegetables were not taxed when imported. Of course now everything is taxed.

It's not considered a fruit, it IS a fruit. It's a fruit because it's in the fruit family. It's actually a fruit that is "considered" (or treated like) a vegetable.

Botanically, yes. However, look at any "Vegetable juice" pack and it will most likely have a Tomato picture as well. Also, it never really goes well with fruits.

Because they are a part of the reproductive organs of the plant. Vegetables are often the root, stem, or leaves of a plant, whereas the berry, or fruit, is where the seeds are.
