Well you'd be sent to jail if you buried the survivors but if you were to bury the dead they would just be sent back to their respective homes and the families would get to decide about the final arrangements. That's why you use two countries in the riddle, not two states. Because certain countries have laws in place preventing the bodies from coming back home. Just so you know.

You don't bury survivors, but if all died it wouldn't matter where the plane crashed because the next of kin would be able to have them buried wherever they wanted.
