what happens if the father does not have a job? are they still supposed to pay? what happens if they don't?

nothing has been ordered by the court yet. he said he had a job when we started going to court, but now he doesn't. so he still has to pay, right?

oh, and he already got his license taken away because he has not paid his other childrens child support

yes. they still have to pay.
my father and i have not seen or talked to eachother in a very long time. me and my mom jsut went to court a little while ago because he has not paid in soo long. the courts accually set a date. he never showed up so now they are looking for him and they are going to make him pay when they find him. he does/did not have a job.

Depending on the State if he is unemployed now he can go to court and ask the judge for some time to find a job, but until that time he can ask that child support stop until a job is found.Child support will not go away, if he owns any property that property can be taken, and sold,
In Illinois, interest builds up every day, on the arrears, the state can take your taxes both fed, and state,to apply to child support if you fall behind., also they can have the court orderup to 20% of the father's income before tax

In the state of Illinois, once a judge issues a support order. It doesn't matter if the father is unemployed or hospitalized for a year. Once the support order goes into effect, child support is owed. If you have an ex husband like mine, he will probably do anything to get out of the support order. Mine quit jobs, moved out of the state, moved back, got another job, then another. It was hard to keep him employed because he knew he had a support order. My kids are now 18 and 20 and I get regular payments for back child support for the next 10 yrs or so, as long as I am here he will owe me that support. Not working don't matter. He finally quit trying to get out of it, or at least for the last 6 months.

Of course he is still supposed to pay. Do you think that just because he has failed to keep a job that his child or children stop eating or needing food and shelter?
Eventually he would be arrested, have to go to court and explain to the judge why he had failed to live up to his court ordered responsibilities.. The rest would be up to the judge. His wages would likely be garnished on any future jobs, tax refunds sent to his children's guardian. The end result? He would owe the entire amount plus fines and costs.... possibly even interest.

If they dont have a job at the time you request child support, they are giving a number amount of days to get a job. After that if they still have not found a job they will then go to jail.

not having a job is no real excuse the court will accept.
I know a young man, who is in jail right now becase he could not pay ( he could not pay because he was in jail for something else) as soon as he got released for the other matter, they arrested him for not paying his child support.
But depending on the state, they can lose thier drivers licence, be found in contempt of court and/or be put in jail.

if not court ordered, not sure what can be done. Go to your child support office and get it court ordered

Hey,,, i have an ex wife.. that had another ex before me..... the sorry rascle would not work... and eventually she would have him brought up in court....
He would go to jail.. until someone in his family coughed up the money due.....
I pay mine all the time on time... after all she is my child also....
Some men,, dont get this......

father is still expected to pay no matter what, if he talks with the judge they may let him put it on hold until he finds another job then make up the back pay, other wise he could end up in jail. (then he really can't pay)
