i have a neighbor who tans nude in a private area that many other people share. is it legal or illegal?

If your neighbor is actually in a private area that cannot be seen from the public right of way, it's probably legal. However, each state and possibly each community has its own rules and regulations (Indecent exposure or public indecency).

Most US states include a statement that it's illegal if it causes affront or alarm to another or that there is something more than simple nudity.

Simple nudity in your own backyard should be fine. Notice, I said "should".

If it's a common area of a private apartment complex, the management would make the rules.

This would depend on the laws of your area.

If it's a private area and other people share it, it is not a private area. He has probably broken a public nudity law.

If your neighbor is knowingly in site of minors then he's most likely breaking the law.

If it's a nude beach, no harm, no foul.

If it's a private area, it's not illegal. It can't be called public indecency if it isn't public. IMHO, simple nudity isn't inherently indecent anyway, but that's how the prudes wrote the laws.

If you live in Ontario, Canada, the rules are left up to the owner of the land/area. Ask the owner if it is allowed.
