I agree. The illegal immigrants aren't paying taxes and are taking advantage of "free" public schools and healthcare, which isn't good for our economy.
And for all the people who say that we came here illegally and took the Native's land: first of all, Native Americans came from Asia by crossing the Berring Strait during the Ice Age, so they immigrated here too. Also, this wasn't a country back then. It didn't have immigration laws that could have been broken.

I think a true mother would want their baby with them but I also believe that in hopes of a better life for the child a family member should have the right to raise the child if mom agrees.

Proud American where would you go? Unless your skin is red you are an illegal alien living off the land stolen from the Native American residents...you know, those that were here first and it was there land. But now, we back them into a corner and offer them grand reservations with casinos. Of course they are still living in poverty. So go ahead, pack your bags and head back to your homeland...that is, if you even know where it is. Before anyone thinks about kicking people out of "our" country, please, I beg of you please, consider how you came to be here. You didn't earn the right. It was taken from others. Good luck in your life and try carrying a flashlight and a compass with you at all times. Judging by your statement you appear to be perpetually lost.

The key to undoing the current misinterpretation of the Fourteenth Amendment is this odd phrase

"AND SUBJECT TO THE JURISDICTION THEREOF."

The whole problem is caused by the fact that the meaning of this phrase, which was clear to anyone versed in legal language in 1868, has slipped with changes in usage. Fortunately, there is a large group of court precedents that make clear what the phrase actually means:

The Fourteenth Amendment EXCLUDES the children of aliens. (The Slaughterhouse Cases (83 U.S. 36 (1873))

The Fourteenth Amendment draws a distinction between the children of aliens and children of citizens. (Minor v. Happersett (88 U.S. 162 (1874))

The phrase "subject to the jurisdiction" REQUIRES "Direct And Immediate ALLEGIENCE" to the United States, NOT just physical presence.
(Elk v. Wilkins 112 U.S. 94 (1884))

There is NO automatic birthright citizenship in a particular case. (Wong Kim Ark Case, 169 U.S. 649 (1898))

The Supreme Court has NEVER confirmed birthright citizenship for the children of illegal aliens, temporary workers, and tourists.
(Plyler v. Doe, 457 U.S. 202, 211 n.10 (1982))

According to estimates, some 200,000 so-called anchor babies are born in the United States every year.
Once a mother has birthed a child on American soil, she can then seek to obtain citizenship for herself on the strength of the family-reunification laws.
Even before this happens, she is very hard to deport, as the mother of an American, and the full panoply of welfare benefits is available to her, as is affirmative action if she is a member of a racial minority.

A group of attorneys and immigration experts are trying to do something about the problem RIGHT NOW.

Craig Nelsen, director of Friends of Immigration Law Enforcement Stated :
"The situation we have today is absurd,There is a huge and growing industry in Asia that arranges tourist visas for pregnant women so they can fly to the United States and give birth to an American. This was not the intent of the Fourteenth Amendment; it makes a mockery of citizenship."

Let's see. My grandparents on my father's side came from Germany...legally. They filled papers and came ashore at Ellis Island. My mother's people came from England in 1720...again, legally; they had purchased land from the Virginia Company. This same kind of behavior was repeated over and over, for every member of my family who immigrated...OR emigrated.

And, this same story is true for thousands of people living legally in the U.S. They all went to the time, trouble and expense of preparing their own way.

Here's my question: why in the world is it suddenly not required of Mexican immigrants that they come in legally? What makes them better than the thousands of people in Japan, or Ireland, or Poland who would also very much like to dispense with the necessities and just roll on in?

Because Mexicans alone are singled out as somehow deserving of suspension of immigration laws, and Russians, East Indians, Bulgarians, Chinese and everyone else don't get any special treatment, it's racism.

I say, they need to go home and sort out their paperwork if they want to come in. It's just so damn basic.

this question will always go both ways...

yes people who are illegal need to get their act together and become apart of the solution.. not stay part of the problem.. well because like everyone says.. OUR ANCESTORS fought for their freedom and fought their way here to become free... to make us legal and make us who we are today..

but what if we never had Ellis island, or any other port that stopped "foreigners\illegals" from entering the united states... then they would have been in the same position back then as with the problem we are having now

children who were born legally in the united states, fight to learn to speak English and become part of the PROUD AMERICAN community.. but because their parents came here illegally, half of them lose their parents and half get "blamed" for why our society is the way it is..

I agree and disagree... YES they need to get their act together.. but NO not everyone needs to go back where they came from as you put it..

Well first of all, you should probably learn how to use a question mark correctly.

Second, I disagree. Do any of you even know illegal aliens? What is it your so fed up with? Them picking your vegetables? Oh send them back! They are intruding on my rights to pick tomatoes!

And it wouldn't hurt to learn a second language either.

kathy059: I have read almost all of your answers and this is the first one I have ever disagreed with.

The 14th Ammendment states:
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside....

If you are illegal and you and your children are not known to be here, you are NOT "subject to the jurisdiction thereof". By defintion a child of an illegal immigrant is not eligible for citizenship automatically because of his birthplace.
