In most states, if a person has been living somewhere more than 30 days, they are considered a resident, and you have to go through the eviction process. If they've been there less than 30 days it's trespassing, and you should be able to get the police to toss them out immediately.
If you are a renter yourself, it can get tricky. If your relative is not on the lease you and your landlord should be able to work together on the eviction. If your relative is on the lease it gets even worse. Best bet here, (other than moving out yourself,) is work things out with the landlord so that he refuses to renew the current lease, then after your relative moves out writes a new lease in your name only.

Call your local police station and ask them what the law is. Believe it or not, you cannot just kick someone out of your house, no matter what they do, if they have lived there for a certain length of time.
I know this because I kicked a free-loading family member out and then at 1 am in the morning two cops were at my door telling me I couldn't do it. So call and find out what your rights are first, because just because you own the home, the law will force you to live with someone you don't want in your house. You have to give them written notice, just like a landlord - even if they aren't paying you anything!

Tactfully tell they can no longer stay with you. You can help them find someplace else.... to a certain extent, but don't do it for them. Give them a definite deadline and make sure they know what that dealine is. Change the locks on the house and/or put in a security system.... and of course don't give them the password. If they try to get in after that, it's plain ole breaking and entering.

You can call the Police for a civil stand by, remove all their clothes and stuff from the house. in bags. Stand in the door way of your home and give him/her criminal trespass warning in front of the police officers.
If he returns, you must stick to your guns and file charges, most people leave and do not come back.
Tough love, works. So just do it. They will go mooch off someone else or get their life straight.

ill tell you the best way ever, it happened to me about a year ago. my brother inlaw moved in with us ,i had three kids and worked at night , my husband drove a truck cross country, and worked long hours, he thought it would be a good thing for his brother to be there at night when i came home from work , so i would not have to come into a empty house, but he was suppose to have a job , and be working threw the daytime, (not!!!!)he layed up , ate every thinginthe house and whatched tv all day ,he was a pig. i whent out , found him a job and told him to get off his ***, .you want have to ask him to leave , they will be gone before the night can fall, make it easy for them to be lazy, you will have them forever.

Be straight forward and honest with the relative....I know we are supposed to love family but living is not free and that relatives needs to know...tell them to help out or get out, simple as that.

OK this is what you do....step one: open the door. step two:put freeloader infront of the door. step three: while freeloader is confused insert your foot to their butt and push. step four: slam the door and call the police for a tresspasser in the yard and deny everything. After the cops arrest them laugh your butt off. Muhahahaha!!!

Or you could make life hell for them. You know, put poop on the pillows, then when they ask about it say, "Sorry, I was leaking. I thought I cleaned it all up." They'll leave.
