Actually, a fruit comes from a flower (think cherry tree, apple tree, they all bloom in the spring and make fruits). A vegetable is a larger term referring to plants you can eat in general, wetter it's the roots, the leaves, the bulb, etc.
But theorically, if you eat something that comes from a plant, it is a vegetable, even if it's a fruit. Following? In botanical terms, nobody refers to one or another, since it's not a scientific word anyway.
Bottom line is, a tomato can be called both!

Fruits come from trees, and have seeds in them, while vegetables come from the ground and usually don't have seeds inside the actual vegetable.

1. fruits come from flower receptacles.
2. there are 4 types of fruits-
a. berry - very small seeds, small fruits in bunches, strawberries, etc
b. drupe - fairly large fruit with one large central seed, peaches, etc
c. hesperidium - fairly large fruit with fleshy part divided into segments, oranges, tomatoes, other citrus fruits, etc
d. dang, i forget the last group.
anyway, if it isnt one of these, then its not a fruit.
