My 16 yr stepdaughter wants to be emancipated. She is a constant runaway, she refuses to deal with the consquences when she gets in trouble. Drinking, Smoking, Curfew, Stealing, Suspensions, etc. She has been on the run for 2 weeks now living with Spanish speaking ppl, (she speaks english only) her bio mother is supporting her 2 be emancipated. (she can't go back and live with mom, cause of her influences on her baby sisters) My husband is against her being emancipated and says she needs to come back here and carry out her concequences. But she refuses. What is to be expected in court and what do Santa Clara County Judges look for when deciding these cases. What will he say?

BTW, She doesnt have a job yet. But I guess is looking.

The judge will see all this and most probably emacipate her. Remember this isn't the first emacipation case that the judge has seen, so he'll probably grant it. The thing is, she probably don't realize what that involves. So she may wind up in jail a couple of times before she starts to mature. If she goes to jail, don't bond her out.....let her learn a lesson. She may get mad at you, but then again, you didn't twist her arm to break the law. After she's emancipated.......then it's all on her...and she needs to fully understand that she's responsible for her own actions........from that point on. Best of luck to you...........
