Whether they have an accident or not, they are guilty of a crime by withholding the truth about a medical condition.
If the person causes an accident because of the condition, the charges will be more severe and his civil liability will be greater because there is intentional harm. No additional evidence of negligence would probably be needed.

Thylawyer is right. You commit an offense by lieing on the application for the license. Then if you cause death or great bodily injury to someone as a result of the condition, you will be criminally charged. You will most likely loose everything that you own.

Most medical conditions will not prevent you from obtaining a license so if you do have something wrong with you that is so severe that it could harm yourself or others while driving then absolutely you should be held accountable. What if your loved one was killed by someone who lied to obtain a license? I'll bet you'd have a pretty strong opinion of what type of punishment that person should receive.

They probably will be charged criminally. I would find them guilty in court. My ex boss, her first husband had epilepsy, and no license, but she let him drive her car, with their baby in it. He had had seizures while driving before. One day he had one, and caused a bad accident. He got killed, their three month old baby got killed, and the other driver was badly hurt.
Lying on your license about something like that is bad, bad bad

first off Diabetes is not a condition where they can stop you from having a license. As for other things i agree they knew about their condition and they knew the dangers. They should be help accountable

If I were a judge then yes I would find them guilty in court. Considering it was proved by there doctor and the question was asked at bmv

if they knowingly lie then yes i would want them to be punished
if on the other hand they had no idea they could end up prone to having a medical problem, then no they should not be punished...

Yes...they should be punished to the Max. extent of the law ! What if they killed someone you Love..or You...they should have to pay restitution too for those that were left behind!
