he will go to court on 7/12/2006 for a possesion of sales case,he in reality did not know that the meth was in our home,but being that he is on parole well they put the meth on him,now he sits in jail because of my fault,i want to go to the public defender and see what i can do for him or else he is looking at some hard time,what can i do for him what is there a motion that we can fill,or should i pay a private attorney?

Get a divorce. You will have nothing but trouble with this man.

First of all, you should pay a grammar teacher to, well, give you lessons, but my suggestion is this:

Go to the public defender who is representing your husband. Tell him your story. Tell him why the meth is your fault and not your husbands. He'll determine then whether or not you should testify at the trial. If you do testify at the trial you should be aware that your testimony could be used against you at a later date in another trial and you may go to jail for possession with intent to sell or whatever your husband is currently charged with.

Ok, Ok, Ok,....now, the meth was yours, honey? I don't think that matters if he was already on PAROLE! If you had a GUN, (but) it wasn't his, but it was in the house, isn't that the same thing? I realize we all need a little pick me up now and then...try Vivarin, next time. Depending on what he was on parole for to begin with, in addition to exactly how much meth? a pound? an ounce? yes, Virginia, I think, he may very well be looking at some 'hard-time'.

You need to hire a good criminal attorney. Its going to be expensive but it will be all the worth it. DON'T let your husband go on trial without a good attorney. And don't leave it up to the public defender. If you love him and want the best for him. Gather your savings and do the right thing and hire someone. Also ask around and get recommendations for a good Criminal Attorney.

I don't quite understand here. You seem to say they(police) put the meth on him, then you say its your fault. Are you trying to say you will take the rap for him so he won't have his parole revoked? That won't work. He has conditions of his parole and being in,near, around, or associated with those who violate the law. Get an attorney.

he may not have known there was meth in the house but im guessing he knew you used it or he knows how it got their past tense. not condoning your actions. but your husband knew the consiquence of it being in the house or being assciated to anyone with it and should have made it a priority. i know this answer isnt what you want and it isnt a feel good answer but, clean yourself up and prove to him that you really love him by making the rest of his life worth getting out for when he does get out becuase noone will take your word on this ( no judge, no district attorney) he is guilty by association.and will serve time for it regardless if you go and take the blame so do you and him a favor find the methadone clinic nearest you clean up and be his backbone while he is doing the time write him help him with cash here and there while in send him books but turning yourself in wont help good luck.......

Your in a very difficult situation, you could go to public defender and try to convince them the substance belonged too you.
The case is hard, as you are spouse, and they may expect you to try and exonerate your husband.On the other hand, you may persuade them with a deposition, that the substance was yours and your husband had "no knowledge" material was in house.
Either way, someone is going to go on trail. Hope this helps you.

get an attorney then decide whether to use him to defend your husband or divorce him. how is it your fault that he is in jail unless it was your meth??

If you love this man the right thing to do is to tell the truth. If the meth was yours, you need to take the fall for it instead of letting him pay for your mistakes.

Was it your meth? He will probally still be in trouble for it being in the house. God I hope you guys don't have kids cause they will probally go away too.
