Okay well i did a whole grade 11 canadian law ISP on this topic. And i can answer some of your questions. You said that "pedophiles should be treated and helped. As long as they are not physically hurting a innocent child they should just be helped. Not jailed up and raped! : 0" And what i have to say is that the rate of pedophiles re-offending are indeterminate. There is not 100% way that a pedophile would stop doing this kinda crap. Also even if they are recieving help or assistance to stop pedophilia, they can only be TREATED but NOT CURED. I agree with you that the ones watching this stuff should not be jailed, only the distributors and especially the makers because they are the actual ones to abuse the children into doing this kind of stuff. But more than half of sexual abuses/rapes/kidnaps and usually results in a killing are done by men who have been aroused by watching child pornography. Since child porn is so easy to access by the internet, it might be necessary to remove these people from the streets for a few years. And yes i think 30 years might be too much, but maybe thats how it is wherever you live, but it's not like that in Canada. It's true that most pedophiles were abused as kids. But basically they can be temporarily healed, but not cured forever.

... so much wrong thinking. A pedophile is a person who thinks about having a sexual relationship with a child more often than not. They are exclusive, and do not think about normal age range acceptable sex. A child wull turn them on sexually. It is also not a crime to be a pedophile. There are actually groups who help people with this kind of attraction (virtual pedophiles) who realize that to actually act out their fantasy would be harmful for a child, and they are not sex offenders any more than a normal heterosexual man is a rapist, just because he has strong sexual attraction to the opposite sex.
What is a crime of course, is having any kind of sexual contact or interaction with a child. Your thoughts though, are your own, and you cannot be charged for them.
Automatically assuming that looking at naked children, whether just proper (legal) nude photo's (many people take photo's of their own children and think they are lovely, and its nothing sexual) or sexualized images of children makes a person a pedophile is a false and wrong conclusion. Some people just do not have the same revulsion to those photos (same as some people can look at photo's of human road kill without vomiting and others cannot) and some people are just curious and don't have the self control to stop their 'research' and online clicking.
People that look at child porn are not at all in the same category as child sex offenders and pedophiles, although some child sex offenders and pedophiles will look at child porn, not all people who look at child porn are child sex offenders and pedophiles.
Some child sex offenders are not even pedophiles, they are situational offenders, these are people that want a sexual experience, and will take it where they can get it. It is not the child itself that they seek, it is just who (another human) is most available at any given time.
The biggest problem with all of this topic is that there are so many assumptions and so few facts. And false information and statements are bandied about. For example, "every time a photo is viewed, the child is abused again" ... well, if no one tells the child, they would never know, for one ... and is the child only abused when a pervert looks at that photo but not a police officer or a judge? (especially when the prosecutors will display this stuff like trophies in the court room even when the accused has already made a guilty plea)
How about this one. People like that should seek help ... I have a question. Where can they go? Truth be told, people that have this problem have no where to go, there is no help, not until you are arrested, and in the system, and then, whether that help is effective or not is another whole question. (punitive vs: restorative justice)
I agree with the poster. It would be better if a person were 'caught' in this activity to be directed to professional helps and to be assessed and counselled. Also warned. And this should all be done discreetly, so as to not ruin this persons life.
Ah, but then, the quota's in the prison industrial complex would not be met, and the billions of dollars made on the backs of human suffering would not be realized. Here's another fact. No one cares about you or your problems. Everyone enjoys seeing someone crash and burn!

If someone is looking at child pornography, then they have probably at some point done something to a child. As far as some of them being born that way, I agree with you, but then that is even more reason we should keep them locked up! If there is something in their brain that makes them do this, no amount of help is going to change that.
On the issues of pedophiles who were abused themselves as children, I'm sorry, but that is no excuse to grow up and hurt a child. There are too many people, including myself, that have been either sexually, mentally or physically abused, and we don't become adults and abuse children.
These are the worse of the worst, and anyone who does anything to a child should be put away for life.

The reason is simple. The laws are written to follow the Christian way of life. There is too much religion in the government. This is the same reason that Homosexuality was considered a mental disease until the 1970's. While I do not agree with the idea of Child Pornography, I also know that there are people that are born like this, same as people are born gay. I may not agree with homosexuality but it is a fact of life, and I have to accept them as such, so should we have to accept that this is a part of life. Right or wrong I think that we need to address this is a social issue and not a criminal one. It is clear that putting them in jail does not work, and medication can only help not cure this matter, but it is also a fact that you can not jail every person with unclean thoughts, otherwise we would all be in jail.

Really! There are several posts here that state that if there was no market for child porn, there would BE NO child porn. How nice that would be. But does anyone really think with the millions of pedophiles out there in the world that it's going to happen? Wake up people. This is an issue that is not going away. Are these people abusing children in a tangible way? Of course not. Are they abusing these children in a way that is morally wrong? Definitely. Please stop thinking the problem will go away if the desire goes away. Ain't gonna happen.

Anyone who downloads this garbage does deserve to be punished. Just because a pedophile hasn't molested a child yet doesn't make them any less a pedophile. If someone is a pedophile and they seek treatment on their own, that's fine, but downloading child porn off the Internet is just one step closer to crossing over from being a pedophile to being a child molester! Those who produce and distribute child porn deserve a stiffer punishment, but those who download, look at and enjoy child porn are also culpable and deserve to be sentenced to prison. If there was no market for child porn, then child porn on the Internet would stop, so all adult participants deserve even tougher sentences than they are getting. That's my opinion of it.

How would you feel if it was your child being abused by some disgusting @sshole?!? I think they should be locked away and studied. People like this can not and SHOULD not be left to live among the people who are around wanting the best for young children. The mind of a pedophile is quite disturbing...they need to be put in a psych ward and not released into "normal society."

Stagitory Rape is a serious crime in the US. It strips a child of the innocence that they should hold onto. It fits in with the many other topics on the maturity of our children going up to early because of media, and other adult factions in the world. The other factor in the stagitory, is the fact it takes the virginity away from the child for the future marriage. This relates back to the old days, where a woman had to keep her virginity before she was married, so that the consumation could be real. And so she would only experience sex with that one individual.
So. Looking at Child Pornography, is a heinous crime, because we are programmed in and of ourselves to believe it to be so. Maximum jail time is the only thing to do for a crime as heinous.
As for the alternative punishments? I would lock them up in an institution specifically made for them. And then throw them in a room tied up, with the parents of the child they were looking at.

I agree. Sending them to jail for up to 30 years is only going to create a better criminal. Mandatory therapy should be the preferred course of action because, as you said, many pedophiles were abused as children and were never given help dealing with that.

A very daring question you asked. You won't get much (any) sympathy from the general public on this.
I hate to admit it, but I did almost 4 years in federal prison for the very crime you mention, and of course I think it was too much. I have completed 'treatment' but that is only half the battle.
Now it's almost impossible for me to get a job. I had one for 9 months until someone 'turned me in' to the main company and I got fired for no other reason.
It's also very hard to find a place to live. If my father didn't let me live with him these 3 years I've been out, I guess I'd be sleeping in a ditch, which would probably be fine with most people.
And yes, when everyone hates you so much for your past, no matter how hard you try to improve yourself, it does lead to seemingly hopeless situations and thoughts of suicide.
