If you present a police report to the rental company, then they probably would get their insurance to sue the unlicensed motorist. They'd get their money back and chances are good, you'd still be okay. But it's always a good idea to pay a little extra for insurance, just in case.

You should check your policy but your insurance will generally cover the loss for a rental car if you have uninsured motorist coverage. That is why GENERALLY it is not advisable to purchase the insurance coverage when renting a car

You would. The uninsured motorist would go to prison for a couple of years. I believe the only way the uninsured motorist would pay for it is if you sued that person.

The insurance companies have agreement that give them a rite to subrogation, the other company must be a signer on the subrogation agreement if not then they may not collect anything. The other person must have insurance if they have no insurance they will attempt to collect

That happ. to my brother in Cali. A girl pulled out in front of him and totalled his girlfriends car. My brother said the girl that hit him did not have license or insurance. So usually in that case ur insurance will have to pay. My brothers girlfriends' insurance gave her money for her car but, I'm not sure what they did to they other girl.

wow this has gotta suck on your part. BUT they hopefully received a huge fine for no license AND no insurance and if they have none of that whose car was it? If they are a minor their parents will be responsible, I see this going to small claims court hun. Good Luck hope all is in your favor.
