If the person gave you Aids and this person knew that they had it then you could sue them. But for an STD you can't sue that is why there is counteractive you could use before engaging in to sexual activities. Hard lesson learn. Get educated on-line or talk to your doctor or someone you could trust or give you advice on it. Always use protect before having sex that's the bottom line. I too learned it the hard way. The procedure and civil trial would not be pleasant for anyone involved, probably you at most, and the outcome less than certain. You might have to shop extensively for an attorney to do this for you, and I don't know how much I would trust one that would take on this kind of case. This might be a good opportunity for you to re-evaluate your choices of sexual partners, and perhaps develop a new approach, such as getting to know someone and trusting them before embarking on that part of the relationship.

In short, not everything that is unethical is illegal and not everything that is illegal is unethical.

I guess you could try. If they absolutely knew they had it, and you could prove that they knew they had it. Otherwise, they just might deny it and say they never knew.

Also, if you had consensual sex with them, then you really have no case, since you pretty much consented to it.

I would say yes, because first of all i take it that hhe or she was more than friends. whoever they are should have told you.

My friend mother is trying to give her hiv, how sick is that first we have to wait for the window period ....she is only 20 had no sex nothing......

so i would say yes, it isn't your fault, because you trusted someone it would help your case if you had proof.

I think so! It will be interesting to prove with HIPAA, though.

ps-For those saying "should have used a rubber" condoms don't protect you much from herpes, warts, and crabs!
