You should probably be contacting the INS about this to see if there really is a case on him. As for lawyers, try the legal aid dept. in your county to see if they can help.

I think I have a simple answer for you. I said I think......Anyway, Congress is debating this ussue. Senate wants a comprehenssive immigration policy like Pres. Bush. People like to think it's an Amnersty Program. I think it's not. Doesn't amnesty mean immediate. The illegal aliens would get immediate citizenship.. I think that's amnesty. What the Senate proposes is the there be steps to legalization for those who are here illegally. Step 1 - 5 + yrs in America (Background check, pay a fine, learn English, maybe learn American Civics...)......Then it gets strickter for those who have lived here for less years. On the other hand, the House wants to pretty much send all of the illegals home (not exactly, but that's the climate in the House of Rep). The Senate and the House are at odds about this. They cannot agree. In my opinion, they cannot, in good conscience ever approve of a bill like the House's. It's too extreme. Small businesses would probably have to shut down because of no help (restaurants, construction, etc...). That would not bode well with our economy. Anyway, the Senate's plan is more down the middle and realistic. I think it will pass this year.
Here's my opinion. WAIT this year for the bill to pass. I think it will. You know why? You will save youself so much money if you do. And, it's an elections year !!!! It's about Republicans vs. Democrats, again. They will all say what you want to hear. Most of the people in America want the "middle of the rode plan." Therefore, the politicians have to listen to the people who voted them in. They have to vote for the Senate's plan.
I just wanted to give you an "outside of the box" alternative. It's a risk but I think you guys have gone down that road before. It won't be so hard this time. There is a light at the end of the tunnel. Truly believe this. Don't be afraid.

His first case has been made null and void. You will need to start the application case over again. However, this time he will need to present to the US consulate/embassy in Nicaragua for final processing. If his application is approved, he will be processed at a border city for legal entry. If by some chance he "sneaks" back in, he'll still be forced to leave and re-enter legally. An immigration attorney will help you immensely with this matter, because there may be fines involved with the violation of his first petition request. I'm sure if you call legal aid they can refer you to immigration attorneys who would be willing to work with you within your budget. Just be prepared (and save up) because you will have to interview with him at the US consulate in Nicaragua when and if you are granted an interview. You'll need to supply all the necessary documentation and proof of a legitimate marriage during that interview. The longer you wait, the more "unbelievable" the validity of your marriage. Good luck!

How did you get marriage license? He would have had to show some type of papers, if he used false one it will be hard to get him back into country. Wife & daughter will not help if he falsified legal papers. He was here a year & gone 5 years & you do not wonder why". Try an Immigration Group rather than attorney first.

You only can have 1 case in immigration, to not double cross yourself. You can check the status of the case with the number in the Immigration Home page, if you do not have a number or receipt, you need to find the way to figure with a lawyer with a connection inside, but you do not open a new process, you could mess up your future for sure.

It's easier and cheaper to just report him to Immigration. You might get a reward, and California divorce laws really financially rape fathers!!! Good luck, heheheheh...
