Sounds like a good legal case to me. Like other posters said, you will have to contact a lawyer, but from the sounds of things, it would definitely be worth your time.

You of course need to check with a lawyer to be sure. However, many states have mandatory reporting laws for certain conditions. These require a health care professional to report even a suspicion of a condition. The law also in most states shields the reporter from any legal actions that might follow their report. Check this out before you spend money on a lawyer. In a case were the doctor can argue that he was protecting the public I think his lawyer would take it to trial. And getting a doctor to testify against another doctor is hard as hell

He definitely has a malpractice case.
You need three things for malpractice. The doctor must owe you a duty. He must fail in that duty. And you must be damaged (no link must be proven between the duty and the damage).
In this case, the ER doc most definitely has a duty to base his diagnosis on proper diagnostic work and an appropriate interview. Also, he must make the same diagnosis that a reasonable doctor would make when presented by the same conditions.
If he failed to do that. Obviously you have incurred damages. Not to mention that your doctor broke patient confidentiality based on incorrect info.....basically ruining your reputation in a public manner with people in authority no less.
I am NOT a big fan of malpractice. But, in this case, you should contact a lawyer.

There is usually a lawyer referral service in the phone book. Call them and ask if there is a lawyer that has specialities that could help your dad. The lawyer will look at what paperwork you have and tell you if you have a case, or not.

I suggest you contact a medical malpractice lawyer right away and also I would take his medical records that prove all the test results to the drivers bureau or whomever took his license away.
I would contact a lawyer ASAP!

Unfortunately, he probably doesn't have a case. If he did find a lawyer who would take the case on a contingency, the damages ($ awarded) would be minimal and the lawyer would take a big chunk of that money

I've been through so much after my Dads massive stroke.The best advice I can give you is to keep a note book,don't leave anything out,stress causes you to forget some things.Write it all down as it happens, good luck to you,stay strong and know that mircales happen everyday....Fingers crossed,Dominique
