My step sons mother has admitted to being on drugs and is homeless, he has been with me and his father for a while now, she has told us that she is going to come get him and take him to another state...we have no custody of him at all...we didnt push the issue because we didnt think that she would go this far, now I need some way to stop her ASAP from coming to get him and taking off with him. Any advice?

I would start with CASA and petition for temporary custody until a hearing can be arranged. This will probably get ugly really fast and you want someone who will act as the voice for the child. Even if they can't help, they can help you find the right resources. Good luck to all of you.

Get a lawyer and ask for temporary custody of the child, stating that the mother is a drug addict and has no way to support herself never mind her son. Then go for full custody stating same.

Your husband should file a petition for temporary custody but also request that she not be able to take him out of the area and that she proves she can provide for him. If she's on drugs then more than likely she was just talking. Depending on the age of your stepson it could be his decision where he wants to go. If you can get some proof of her lifestyle that would really go a long way.

Yes ... Contact Family Court immediately, gain custody immediately and do not let him have any contact with her that is not supervised. He does not need to be exposed to this. If you have a lawyer, contact them and get things going on a fast track. In the meantime. do not Surrender the boy to her under any circumstances. She can wail all she wants, but her only recourse will be to seek court intervention, and that is where you want to be anyway.

DO SOMETHING NOW!!! My husband and I were in a similar position 4 years ago, and no matter how hard I urged him to, he didn't have the custody order changed, she moved and took them with her, and there was nothing we could do. It was 5 months before we even got into court to start proceedings.

Start the custody process. Once the judge sees her condition, there's no way she'll be able to take him.

how old is the boy?how can you have no custody of him at all if theres no dispute that hes the father and theres never been custody decided thenhes his fathers as well as mothers

Speak to an attny.......In fact perhaps the same one who granted the divorce, if possible. It's DAD's place to put a halt to her leaving the area WITH their son, under such conditions.

before you take any irresponsible action, take some time with her and ask her how she would feel if her son were on drugs and on the streets like she was. ask her if taking him away will only make him feel safe or in danger. it'll work itself out. good luck.
