Husband was recently ordered to pay child support for his daughter from a previous relationship. We (hubby and I) have the child 3 overnights per week. Can the child support be reduced if we ask the courts to do this? Thanks!!

We have the child from Tues-Wed, Thur-Fri, and Sat-Sun. We have already gone to court to try and get joint custody. The judge denied him because the mother said "no"!! The three overnights we have her is court ordered. Would we have a better chance of getting joint custody if we had a lawyer? This court system here SUCKS!!

Thanks for all your advice and answers. One more thought...the only reason we want it reduced is because we supply EVERYTHING for the child when she is with us. Diapers, wipes, clothes. The mother drops off the child to us and that is it. No diaper bag or anything. If we supply for her 3 overnights per week, why should we also pay for things when she is with her mother? We also pay for her medical insurance!!!

Sure you can always ask but you will need to be able to say why it should be reduced not just because you guys don't want to pay that much.
Contact an attorney. That should be fairly cheap to just explore the realm of possibility. See what He/she says about it and explain to them why you want it reduced. It would help your cause even more if your significant other lost his job or didn't make as much but that won't help you guys financially now will it.

If you have court ordered shared custody you can probably get the order reduced. But if you can't prove it - I doubt if it will be reduced just because you walk in there and say you have the kid on weekends. You need to get partial custody. Just because the father has the kid on the weekends doesn't mean he deserves to pay less support. He's only doing what any father should do - spend time with his kid.

If it was a recent order, you can always appeal it. You can also file a petition to have your child support reduced. Your best bet is to get a lawyer who will argue for you. Make sure you provide your check stubs and the agreement that has your child at the house for over half th

Not usually, unless father takes daughter more to reduce time with mom,but usually is really hard to get courts to reduce child support unless very unusual circumstances have arisen, usually state officials have dictated amounts as state standards for custody purposes good luck as it cant hurt to try but may cost you for your lawyer

yes it can be reduced, if the person is not making the amount they were making when that the support was started, of course it will require court proceedings, a request and then a court case to reduce it.

Yes, support can be reduced - 3 nights per week is practically joint custody! Any reduction you might get is not retroactive, however.

If he was recently ordered and the arrangement that you to have was in effect at the time of the child support order, then I am sorry but your out of luck unless your husband has had a drastic cut in his pay.
