okay, my boyfriend of 8 years and father of my 2 kids died in a work related accident on may12, 2006. he was driving semi. his boss did not have workers comp on him. we live in mn and their is a special fund if the employer did not have it. so they might pay up to 15,000 for the funeral costs. my question is are our children eligible for any worker comp benefits? are there any? we live in mn. i do get social security, but that doesnt add up. are there any lawyers or anyone that knows anything about this stuff? thank you for your time.

You need to ask a lawyer, not on the internet either, but a real, live attorney. If you lived with him for a certain amount of time, you may have been considered to be in a common law marriage. The laws vary from state to state, which is why you need to consult an attorney where you live. I'm so sorry for your loss, you and your children have my deepest sympathies.

I agree with the above that suggests consulting an attorney. Most lawyers have free initial consultations to discuss your case, determine whether it's worthwhile to pursue it, and discuss how much it would cost you to retain that firm's services. Schedule several such consultations.

My son gets Social Security Survivor's benefits from his dad; I was ineligible for ex-spouse benefits because my own income was too high.

If their dad was in a Union, contact that office as well, to see if there are any other funds or services to which you or the children might be entitled. Was there a pension, life/disability insurance, or retirement fund he had?

your childredn should draw social security on him til they are 18.
check out socialsecurity.gov and look at benifits. not sure about workmens comp. your county might have free legal advice like once a week or something. call family-children services and ask.

i think it is illegal not to carry workers comp on your employees call ur local dept of labor or unemployment and ask you may have a good case against his employer

you and your kids should get social sec. and the job he was on should be responsible for him dying while performing on the job. i would get a lawyer or find the legal aid office in your area...sorry for your loss
