They go free. That happened recently with a convicted Iraqi criminal. After his sentence Iraq wouldn't take him back and we have no treaties with the new government on this point.
Guantanamo is full of this problem, by the way. All countries seem to want people released, but the countries don't want the people they have there back in their own countries.

You can't be deported until the receiving country has agreed to accept you. It could be country of birth, country of citizenship, country of last embarkation, or any other willing country. Until then, you may be held in detention, or released under order.

It depends on the treaty between the US and the country. If they would not take them back the US would put them on trial and if convicted they would serve jail time. Then it would start all over again.

IF that should happen ... you apply for Refugee status ... but that's not the case with I would venture 99.99% of the illegals in the United States .... so let's say it's a hypothetical question, right?

don't get caught by the immigration authorities, and apply for citizenship the legal way......it'll take years....but you'll be legal and in no danger of deportation. Best of luck to you........

I guess they would send them back to their point of entry, either Mexico or Canada. Because you wouldn't be able to enter here legally anywhere else without proper paper work.

from what I understand, if your home country denies your rreturn the country you are in may see fit to accept you or you could find another country that is more open to immigrants.
