It really should be. You sould do something about it. Make it a law.

Pick your source before deciding second hand smoke is worse than any other contaminate you might be breathing during the course of a usual day. Nonsmokers want to believe it is. Hey we'd all wish body odor was a hazard then we wouldn't have to put up with the unpleasentness of stinky people. Why not outlaw perfume in public since some people are allergic, causes sneezing fits and all sorts of immediate irritation.
When there isn't even a reliable provable consensus and current studies are shrouded in contreversy it muddies the water. For instance the big EPA study years ago judge tossed it out and ruled they cherry picked their data etc. However upon appeal another judge reinstated it not based on the fact it was an accurate study but on the premise that the previous judge had exceeded his authority in tossing it out.
On top of that the government has enough safety laws as it is, much less trying to force another one on that would just show up in a court case that would most likely be settled not through fact but through politics.
Seems to me all these "keep everyone safe" laws we see popping up just encourages over population and the fiscal drain of more people on Social Security to keep those who would have been bleached out of the gene pool by natural selection long ago happy in their Golden Years.
The government can keep their laws out of private property thanks, enough intrusion already.

Well you see, some people have this crazy notion that some parts of the world are free and we don't live in police states...how stoopid are they?
If we try to pull people up on EVERY LITTLE (or big) THING THEY DO WRONG we'll have a whole bunch of the population behind bars or very disgruntled with society.
Call me crazy, but instead of prosecuting the victims of tobacco, maybe we should go after the criminal masterminds that are the tobacco companies?

First of all its endangerment, second my mother, father, grandmother and grandfather all smoked with me in the car and I don't have cancer. My lungs developed fine, I don't have asthma, there is nothing wrong with me. So, instead of shoving your face into someone else's car maybe you should be paying attention to the road. Secondhand smoke is not deadly- if it were millions of us wouldn't have survived through our teenage years.

Because second hand smoke is not nearly as "deadly" as the putting them in the car part.
Driving kills TONS of people but we do it with complete frivolity.

Because it is hard to persuade the courts to separate children from their parents if the only bad thing they do is smoke. Unfortunately there are no laws saying you have to be a non-smoker to have children, though I think it might not be a bad idea.

I am glad you ask this because I think it should be a crime . This just goes to show how ignorant our society can be. They don't want you to spank your child but it's OK to smoke them to death

Ugh I so agree...My mum smoked while pregnant with me! I am angry but she still thinks that it isn't dangerous! >:(
Luckily for me, I didn't turn out damaged in anyway......well not that I know of......*ponders....*
I hate women that smoke while they are pregnant......if they cannot give up, don't have a kid.
