we don't know who gave it to who. I started having symptoms first and we both had outbreaks at the same time. How can I find out who had it first(me or him) Can we still have sexual intercourse if we are treating ourselves and can we have oral sex with each other?

If you both got it about the same time, it's going to be almost impossible to find out who gave it to who.
Of course you can still have sex, protected or not. Once you have it you will always have it, it's not like you are going to reinfect him or vice versa.
As for oral sex, there is A LOT of debate about it. I personally believe that you cannot get cold sores (herpes simplex 1) from giving oral sex to someone who has genital herpes (herpes simplex 2). They are two different strands of the virus.
I have genital herpes and and my fiance doesn't, even after being together for 5 years. Occasionally we have oral sex and he has never gotten herpes from me, either strand.

I got diagnosed with herpes simplex virus (type 2) about five years ago, when I was still attending college and had a mindless one-night stand. I understand loads of young women say this, but I swear I had never done that sort of thing before. The way to initially get herpes is if someone with a cold sore (Herpes Simplex 1) performs oral sex on you, thus giving you (Herpes Simplex 2). Herpes 2 is still a cold sore that comes and goes. The location is just located on the sexual organs. Because Herpes is a virus, it is hard to treat because virus live in surrounding cells. If ya kill the cells with medicines, then you kill the person infected. Not good. It is imperative to monitor your outbreaks whether for sex or child birthing.

Once you are infected, you really can't find out who got it first. Though, first outbreaks tend to be more severe... so whoever had a more severe outbreak most likely got it from the other partner. If you are taking anti-virals such as Valtrex, you still need to be careful because you can still give it to someone who doesn't have it, even if you don't have an outbreak. You can still have intercourse with your partner though, just avoid intercourse during times of outbreaks. If you both have genital herpes, it is possible to get oral herpes with oral sex, so please use a condom if possible.

Seems a little late to be worrying about who 'started' this. Condoms, Valtrex and being very very observant about signs with your bodies helps to prevent outbreaks. Be afraid of oral sex. (I would be)
