If the guy has a cut on his penis that is open or if he has a sore on his penis then yes, he can contract HIV from oral sex. But HIV is mainly transferred by semen or blood, not so much from saliva, but just be careful anyway...hope this helps!

The AIDS virus can be secreted in saliva, but only rarely and in very small amounts with no evidence that the fluid by itself poses a serious risk of infecting other people, researchers told a dental research gathering yesterday.
The report, from a group at the medical center at the University of California at San Francisco, also suggests that for mass screening of large populations, saliva samples may be nearly as useful and far easier to get than blood samples.
Although saliva rarely carries the human immunodeficiency virus, or HIV, that causes AIDS, a new study of saliva samples from 50 homosexual men whose blood was positive for the virus found that 47, or 94 percent, had the antibody to the virus in their saliva.
The HIV antibody, created by the body in an effort to fight AIDS, can not transmit an infection but it is a marker for the presence of the virus. "This means that for surveying for AIDS infection, saliva may be very useful," said Dr. Deborah Greenspan, the lead author of the study presented at the meeting of the American Association for Dental Research at the Hilton hotel.
Greenspan said results should reassure people worried that AIDS may be passed by kissing or casual contact. "I would never say getting AIDS from a kiss is impossible," she said, "but the fact is that it has not been observed to happen" and the findings reinforce the belief that the chances are remote.

HIV can be transmitted from an infected person to another through:
Blood (including menstrual blood)
Semen
Vaginal secretions
Breast milk
Blood contains the highest concentration of the virus, followed closely by semen, followed by vaginal fluids. These are the three basic fluids that infect adults with HIV.
The risk from these fluids can be worsened or lessened depending on how they get into someone else's body, which we will discuss below.
Breast milk can contain a high concentration of the virus, but in this situation, transmissibility depends on who and how. An adult can ingest a small amount of breast milk at minimal risk. But an infant, with its very small body and newly forming immune system, consumes vast quantities of breast milk relative to its body weight. Therefore an infant is at risk from breast milk, whereas an adult probably is not.

HIV might be transmitted from an infected person to another through:
pre-seminal fluid (pre-***)
Pre-seminal fluid is a clear fluid that lubricates men's urethras. It is produced by a different gland than semen. Pre-seminal fluid can contain small amounts of HIV, and so there is a potential risk. However, in practice, the risk is much, much lower than that from blood, semen or vaginal fluid. As in all transmission situations, risk depends on where the fluid is going.

Non-Infectious "Bodily Fluids"
Saliva
Tears
Sweat
Feces
Urine
These fluids and substances cannot transmit HIV. Sweat contains no HIV.
The other fluids do not contain enough HIV to infect another person. This is regardless of how they get into the bloodstream. No cases of HIV transmission have ever been documented as a result of these substances. See below for more information.

The most important thing to do is not to have any sexual relations with anyone who is infected with the virus, chances are you may contract it, regardless of if your chances are slim with oral sex.

HIV is not passed through saliva unless that person is bleeding copiously. If the guy had it then he could pass it through the semen but it cant be passed through saliva.
