Services are tangible when they carry a price tag. It is at the discretion of your state whether or not services are taxed. The bottled water question is similar; some states may consider smaller bottles of water as the same type of product as soda, and therefore may impose a "junk food" tax. The gallon jug of water is probably viewed as a staple grocery item, therefore not subject to sales taxes.

Disani and the other one is owned by the pepsi/coke companies. Not sure about the others.

They can tax prepared foods. I sell lobsters and if I sell them live there's no tax but if I cook them first there's tax. There is no tax on water but there is on soda. I guess the state can decide what is essential and what isn't.
