that if you do not receive notification of exceeding the speed limit within a 14 day period that you cannot receive fixed penalty points or a fine...?
I was in the car with my brother.. we were chatting away and then realised he was going 35mph in a 30mph country lane zone. It's highly possible he will receivepoints as a friend of mine got them for going 32 mph in a 30mph area!
If the above isn't true about the 14 day notification period .... any legal experts out there?

I think you may be a little confused over this. The penalty notice is issued automatically and it is generally deemed as served on this day, otherwise people would just 'not receive' their notices or receive them on the fifteenth day.

When the notice is received you have to decide whether you will accept it or argue the case. If you choose the latter the Crown Prosecution Service (CPS) is under a legal duty to disclose primary evidence to the defence and this must be done 14 days(i think) prior to the hearing so that you have time to prepare your case. Because of the sheer magnitude of people who are choosing to do this the CPS have struggled with getting this evidence to people on time and as a result cases have been chucked out upon hearing. It should be noted that this is a technicality and SHOULD NOT be relied upon. In any event there are other factors to take into account such as the last time the machine was properly callibrated.

I have never heard of the above14 day period which you are claiming may exist and I am intrigued enough to say I will look into it though. I don't want to sound patronising but the best way to avoid speeding fines is to chat a little less and concentrate on the speedo a little more!!

Checked this out and there is no such rule.

For starters the speed settings on most cameras is 10% + 2 to allow for manufacturing errors.

Next, if you check your speedo against a GPS receiver you will probably find that your speedo under reads anyway, this is often made worse by fitting low profile tyres on standard rims.

So your indicated 35 might be just in - only problem is the time limit is 28 days not 14, sorry.

Gatso camera's give you a little allowance over the limit, so your friend must be the unluckiest person in the world to have got done doing 32 mph in a 30 mph area! In fact if I were him, I wouldn't leave the house! Someone out there is after him, run!

If you have not received notification yet then forget about it. The camera may have not been working which is very possible
