A cop walks into a crime scene. It appears to be a suicide. the cop picks up a tape recorder and presses play. He hears, "I hate my life, I don't want to live anymore." And then a gunshot. the cop turns to his partner and says this is a murder, not a suicide. how does he know that?

Well, assuming the obvious that the dead is not a women or single...
Then the answer is that the tape recorder is rewinded to the beginning after the victim is dead.

Only thing I can think of is because he had to press play, someone had to turn it off??? Then again, it could automatically shut off once the tape is used up.

someone else had to press stop then rewind the tape so that when the cop presses play he hears it... it couldnt be the dead guy.. because he is dead.

Since the tape recorder was off, it had to be turned off by the killer.
