i moved into an apartment that the old tenant left off the lease and left her things behind. so i moved out of the dirty apartment this week and i took her matress with me because she left it. she still stays friends with the guy who lives there and has been moving things for the past 2 months. she knew i was using her matress and got all pissed off. you would think she would have taken it with the rest of her bed. now she's taking more things but i moved the matress with me and she's calling the cops to come get me. is the matress fair game because she left it or do i give it back???

i moved into an apartment which the old tenant left. she removed herself from the lease and the roommate i had signed on. now she left alot of things behind including her bed. about a month after i moved in she started taking things that she had left, and whe she found out i was using her matress got really upset. she took everything out but her matress, and since i moved out i took the matress with me because the roommate that she stays close with said you should take it when you leave. so i now have it and now she comes back for it and has gotten all upset. is it fair game because she left it to begin with and just recently wants all her stuff back? or should i have it back? don't forget she moved out like 4 months ago and could have taken it then but just NOW wants to get all her stuff.

Tell her to go to hell. Tell her it's yours now and if she makes any more noise you will dump it so no one can find it or have it. She can't do a thing to you. Can she go to the police? I don't think so.

Give it back. Why do you want someone else's skanky, smelly, dirty mattress anyway?

However, the property is HERS, NOT YOURS. YOU HAVE NO CLAIM to the property, other than the fact that she was generous enough to let you use it for four months.

What is your problem here? Sounds to me like you've got some axe to grind with the girl. And it sounds like she's got a case that you took her property since there are a couple of her friends still LIVING in the apartment.

You took something that didn't belong to you. Grow up, act like an adult, and give it back.

The mattress is fair game. Once she moved out she chose to abandon her items in the apartment. It was only out of kindness that she was allowed to remove other items, after she left. If she sues for theft you could equally counter sue for storage of her items. The police will do nothing as this is a civil matter. If she gives you an attitude tell her to sue you, or go on Judge Judy!

the mattress is fair game only if it was "abandoned". since she still makes a proprietary claim, then it is not abandoned. i would return it unless you think it is worth being charged with theft for an old mattress...
