Depends on what it's garnished for. If something like back taxes, back child support or defaulted student loans, yes your tax refund can and most likely will be taken. If it's for something like credit cards, no.

If the garnishment is from the Federal government you won't be getting a refund, it will be offset to pay on the federal balance due.
If it is State Taxes, If the State of CA sent in a notice to IRS to offset your refund to the State it will happen.

i think it depends on who is garnishing you... if it is the irs or government..then yes they can take it
