I have a bill at a collection agency and I had set up payments before coming directly out of my checking acct but I decided not to renew and pay myself via their website. I got a call and I was told that if I didn't set up another automatic debit they would seek judgement against me and begin garnishing my wages. She also went on to say that she saw where I was getting a substantial income tax this year and where I was working again (none of which is true). Can they do that as long as I am paying or are these just scare tactics?

If you are paying as agreed, they really wouldn't have much standing in front of a judge to garnish your wages.

Just keep paying them and ignore their threats, if they sue, let them explain to the judge why they sued someone who was paying just as he said he would.

I agree with Gem, if you are still making the required payments at the required time of the month that you have in your agreement (hopefully a written agreement) then they would be in violation if they try to sue you.

I say ignore them and pay them every month through the web.. what they gonna do, reject your payment? As long as you print the confirmation page after each payment you should be good..

i hate automatic debits.. i like to pay my bills when i want and on the date that i see fit..

They can seek a judgement against you at any time.

Normally as long as you are making payments they'll let it go. They don't wantto have to rely on you to send the payment. By collecting it automatically, it helps to assure that they will get paid.

You have gotten a lot of good answers. The only thing I want to add is you can't just ignore collectors.

I suggest sending them a letter asking to not be contacted by phone. (mail only) This will help you only get the facts, collectors will not lie in black and white giving you prof you use against them.
