I am buying a used car and my insurance company says it needs to be smog tested, i would like to know who has to pay for the smog test the seller or the buyer if you already agreed on buying the car but have not transfered the names on the registration.

Depends on the state. In Massachusetts you pay for the test.
Its not legal to sell a car in Massachusetts with an inspection sticker on it. When you sell a car you must remove the inspection sticker( its only valid with your registration)
It also validates your lemon law warranty in Massachusetts.
You have 7 days to get the vehicle inspected. This applies to dealer and private sales.

Check with your states (DMV) office because it will vary from state to state, example in California the seller must perform this as well as pay for it before he or she can sell it.

In Texas, it is illegal to sell a vehicle without a current inspection, which includes the smog test. In other words, make that a prerequisite for your buying it. This would make it the sellers responsibility.

If your buying from an individual then its under the seller's discretion. But either one can pay. Depends on what you agree upon.
