i recently like for about 2 weeks have been getting garnished for a fine form 1997..i have a court date for april3 ..i guess to see if its paid or not but my question is when i go to file my fereal taxes can they take it????

Generally yes. If the state has turned the debt over to FMS you can count on it. Not all states turn all debts over for Federal capture by FMS but it is an option open to them.
