Cps has given me custody of my sisters two infant boys because she a drug addict. She left the boys with her busband a month ago who is aillegal alien. On Christmas he decided to then leave me to care for them alone. It became clear what had been going on when I were'nt around enough. He brought to me me with denim shorts and t-shirts, no food, no carseats, the oldest boys face is all stracthed up and he has a foot fungus at 2yrs.old. The baby is 16 months old and he only wanted me to give him skim milk. He has expressed that it is in the best instrest that I care for the boys. But he thinks if he has custody of some sort that he'll become a citizen ,now that the marriage card won't get him a green card. I know it's not the best intrest of my nephew to be with him but his only concern is to stay here. Can he get citizenship for having joint custody if the boy lives with me?

Babies born in the U.S. are not old enough to petition for their parents. A U.S. son or daughter of an alien must be 21 years old to file for an immigrant visa for a parent.

An illegal alien who has children born in the U.S. remains an illegal alien, subject to arrest and deportation. Every week, illegal aliens are removed from the U.S., and they take their U.S. born children with them.

U.S.-born children cannot sponsor their parents for immigration to the United States until reaching adulthood, and illegal immigrant parents do not gain any additional legal rights based solely on the fact that they have had a child born in the U.S.

According to a study conducted a few years ago, births to illegals now account for nearly 1 out of every 10 births in the United States. None of their parents gained residence status or citizenship as the result of those babies.

You need to contact the Department of Children and Family Services, and you need to petition the court for full custody and get an attorney, WHAT IS THE MATTER WITH PEOPLE!!!

probably not , if the child was born here it becomes a citizen, but not the parent

sorry, i don't think so. There was all this mess about kids having to leave america with their parents because the parents are'nt americn! Try going to Canada!!!

he cant get citzenship either way
the best thing to do is turn he illegal behind into the authorities for abuse and neglect
then after he is prosecuted he will be deported and no more problem

no , the child can be granted citizenship but th parents will be deported if caught. yes its messed up.

The kids are but thier parents should be sent back to mexico.

If a kid is born in the US, he automatically gets citizenship. Unfortunately, the mom doesn't. I think she should, but that's just me.

Unfortuanally the kids that they "poop" out in this countey are citizens in the techinical sence, but they are in no way Americans in my opinion.
