I am very young and just getting out of a verbally abusive relationship. I don't know whether to try for sole custody of my 3 month old and child support. He has a record but it was before he was 18 so it was expunged (it was for assult). He is very verbally abusive even in front of our son and I am scared it will lead to physical. I need legal advice.

Any idea where I can get legal advice free?

Definitely try for sole custody with supervised visitation.

Contact your state bar association for a list of attorneys who will give you a free initial consultation, and who may handle your case either Pro Bono (no charge) or on a sliding scale.

Depending on what state you are in, there are also battered women's organizations, who will help you obtain legal assistance. This is the search engine I used to pull them up in all 50 states, you may find one for the area that you live in:

Even though he may not have physically assaulted you, verbal abuse is a form of battery and you are doing the right thing in removing yourself and your child from that situation.

I'm just giving you a tip from what I see on the streets from dealing with similar cases as yours,

His record may not have been expunged, it may be sealed because it may have been a juvi record.
to answer ur question, verbal abuse is the start, now that's in front of the baby who starts crying with him yelling, it is only the very beginning..tomorrow, he'll start getting physical, pushing, shoving, then slapping
then holding u against the wall, beating you up like ure no body..then like i see alot... u end up severely injured, if lucky, then how is the baby going to deal with it?
leave him, and file for child support, unless he is willing to change (which hardly happens, if any)

I see it where it starts with verbal, then she ends up dead..because the cycle of abuse gets bigger every time there is confrontation..the circle gets bigger..ask your parents for advice, and report any future incidents with your local law enforcement agency.

You shouldn't take advice from anyone other than an attorney. Unfortunately, that could get expensive with child custody.

It may just be verbal, but it is still abuse. You can go to your local domestic violence shelter. They will not give you legal advice, but they can point you in the right direction.

even though he was young when he was charged with an assault, it can be brought up in his background as something that has not gone away.
get an attorney for sure. your attorney should / can file for divorce, custody, support, and a restraining order with limited visitation rights if any?
if you can not afford an attorney, legal aid will supply one for free. try and see if an attorney will take the case pro bono-they have to donate so much time for free each year as an attorney and usually get stuck with a criminal case. would probably take your over a criminal lots easier.

i dont know about free legal advice, but I think you should def. go for custody and child support. You absolutely dont want your child to be around somebody like that.

Yes you can and you must. I do not know where you are, but legally you must be protected same as your child. You must say where you are in order to advice you where to get legal protection.
