The "wanting to do every thing legally" smacks of wanting to give sis no outs if she should happen to wake up and change her mind.
Whatever happened to being supportive of family?
They should let her have her baby, begin breastfeeding to pass on valuable immunities, provide the only source of natural vitimin K, and to help the babe pass the merconium and she will recieve wonderful benefits too. After a few weeks of mothering her baby, if she still feels it's not right for her, they can worry about paperwork then.

It is the same as doing an open adoption. They have to get a lawyer and have the papers drawn up. She will have to realize what she is giving up. Even though it is a family member adopting she has no say as to how they raise the baby. Once she signs those papers she is no longer legally the mother.

Contact a local lawyer specializing in adoption/family matters. Your friend will have to follow certain guidelines, but a family adoption is pretty straightforward.

Contact local lawyers who specialize in adoptions to discuss the regulations of the state. I would also recommend that the sister who is pregnant get some type of counseling to insure that this is truly what she wants to do.

First, they and the sister should get lawyers. NOT the same lawyer, they should each get there own lawyers to make sure everything is done correctly.
Second, they should sit down with the sister and (a) make sure this is what she wants and (b) work out the details of her relationship and contact with the child. For example, "What will she be called", gift giving, and visitation. These small issues may become BIG things after the birth. Negociate, write them down, and make sure everyone understand and agrees to everything before hand.

I can talk to you if you need it, We have done the same thing, We got a lawyer and filed the paper work. As long as this is what she wants then its really easy. Just go and talk to a family laweyer.it cost us 501.00. When our daughter was born, we got to take her home as soon as she was released. She was born eight week early and had to stay three weeks in the NICU.
