Nobody, at least not legally. A tax preparer is prohibited by law from e-filing a return without your W-2 form in hand and it's not possible to file a paper return without one.

A paystub does NOT have all of the information required to file a proper tax return. Most don't have the employer's FEIN and virtually none of them have the information from blocks 7 through 14 of Form W-2 that may be needed to file a valid return.

In past years some of the storefront tax prep mills offered an advance loan (through bank partners) based upon your final paystub for the year. They did NOT file the actual return until you returned with your Form W-2 and any other required documentation. The problem was that many taxpayers would get that loan and then either file their return themselves or go to a different tax preparer for the final filing. They never paid off the advance loans, leading to massive losses by the banks that funded them.

No one legitimate. In the past, some of the preparers would give you a loan based on an estimate of your refund and would file the actual tax return when you got your W2. Most of them have discontinued that practice.

You have to be really careful this this type of thing. For one, you will pay fees like crazy. For another, your last paycheck isn't necessarily accurate. I work in payroll and I'm about to head into the office to finish some end of year corrections. I have nearly 1000 employees whose last paycheck stub will not match their W2 exactly because we discovered a problem with our automated system last week which caused their wages to be overstated. The last problem is that Congress made a lot of last minute changes to the tax code and it's doubtful that anyone has all of the updated information yet.

Just wait a few more weeks until you get all of your tax documents and the preparers have the correct 2007 forms.

Whoever prepares your income tax return will have to have all documentation on your income. Just the last pay stub is not enough to determine your total earnings, tax deductions, etc.
