My husband and I live together in the state of tennesse for 4 year's and was married for 7 year's. He's military retired and has 100% disabity. Since 2002 I been caring for his, because of his health issues. My husband did'nt want me to work, because of his health, he file for divorce without me knowing about it. I learn about it when papers were serve at our door. Can I get spouse support, because i'm not working and it is very stressful even paying for a lawyer. Which my family and my children is supporting me. We are staying over the same roof, and he trying to put me out of our house.

Sounds to me like he is an idiot, and why did you stay there taking care of him?

Nope. He is no longer in the military first of all. You were only married 7 years next and the minimum for any kind of retirement compensation is 10 years. If you are divorced then why are you still living with him and caring for him? Move out and go back with your family, get your own job and take care of yourself. You will need a lawyer if you want to pay for one or not. Time to move on with you own life and start taking care of yourself and not him.

From my understand you have to be married a certain amount of years to collect any of their retirement. To receive spousal support is not up to the military in general though but up to the courts. UNLESS it is their retirement pay you are seeking.

I do believe thought that the requirement for a spouse to receive a portion of the retired members retirement pay the time frame is much longer then 7 years.

Usually from what I understand is if you are not married to him for more than 10 years in the military, you will not get any benefits. If I was you, talk to a lawyer and see what he can do.

whether or not you get alimony will be based on the states' laws you file in and the judge's decision. you were NOT married the minimum ten years of his military service to qualify for a portion of his retirement pay.

Get a job.. pull yourself out of this. Quit trying to sponge off of your old man.

I mean this in the nicest way possible: Why should you receive benefits from your ex-husband's military service? It simply is not rational. It sucks and I feel for you, but they are his benefits and if you are no longer family I fail to see how they would extend to you.
