i was initially charged with DWI (in texas) but prosecuters dropped the charges and we settled with an obstruction of passage way charge. i was given 12 months deferred adjudicated probation which started last May. i have been good so far and no problems....but today I was pulled over by a local constable and given a speeding ticket (50 in a 40). from a PRACTICAL perspective is this enough to get my probation revoked? i know that probably techincally its a crime but i am thinking that this might be a minor deal...and do i tell my probation officer? she has a pretty volatile personality.

I am a probation officer in Texas.

You need to tell your probation officer - because each month, on your monthly report form, it should ask you if you have had any contact with law enforcement. Also, bring the ticket with you - so your PO can copy it.

Now for the good news. No, it will not affect your probation. Only Class B arrests or higher will be a probation violation. However, be aware that if you get caught driving without a valid DL, or if you start to get tons of traffic tickets, THEN you could end up in court on a motion to adjudicate and revoke your probation.

I have probationers who get speeding tickets. I will sometimes follow up with the agency who wrote the ticket to make sure there is no more to it (that's why I want a copy of the ticket). But, tickets are Class C - so, it's not a violation.

In my 12 years as a probation officer in Indiana, I have never violated anyone's probation for simply picking up a speeding ticket... And yes...tell your probation officer... Withholding information from her will cause you problems... You may have a condition of your deferred adjudication that requires you to report police contact to your PO, and failing to do that WOULD be enough to get your probation revoked... But the speeding ticket itself? I seriously doubt it... Just because you perceive your PO to have a volatile personality doesn't mean she doesn't have to follow the same laws and regulations as every other PO...and ultimately, it's the Judge's decision--not your PO's--about what is and isn't a violation of your probation...

Oh my!! Hmmmm... YOU STILL have your license? That is lucky there - YES TELL the Volatile PO!!! She is going to rant/rave about anything else any way - but if you are not up front with her - she may already have that po-po ticket in front of her, better to be save than sorry - been there - nothing to brag about - but - just be open and honest - done deal - what she gonna do??? NOTTA!!! BUT!!! It may get your probation extended, or (ugly) 30 days in the hole or even 7 - you can do weekends etc. Or even community service - since you live in Texas at least you won't have to shovel snow!!! GOOD LUCK TO YOU!!!!

IT IS A MISDEMEANOR CRIME. TELL HER WHAT IS GOING ON. MORE THEN LIKELY YOU WILL NOT BE REVOKED ON A SPEEDING TICKET.
NOW IF IT WERE A DUI YES MOST DEFINITELY.
KEEP UP THE SOBER ASPECT. WON'T BE LONG AND YOU WILL BE FREE AGAIN AND A LOT WISER.
