my brother did not file his taxes last year. I am sure that he doesn't have to pay anything in. I have two questions: What will his penalty be? and he lost all of his w2's from last year. what does he have to do to get a copy of those w2's? Does he even have to get a copy of his w2's to file for last year. He says that he doesn't have to, the IRS has a record already. But this is my brother and he was stupid enough not to file last year. What does he have to do to file for last year??????? thanks for any advice

visit IRS website: www. irs.gov and down load Form 4506-T to request W2 for previous years. . OR call 1-800-829-1040 and the information (W2) will be sent to him. he can also call the local IRS office in your city and or walk-in and request the information and will be given to him immediately. He should file the return ASAP, he will be charge some penalties for late filing. HE should file the 2006 tax return before he files his 2007 income tax return. If he files his 2007 before his 2006 and has a refund due to him, he will not get the refund until he files his 2006 income tax return and must be fully processed before the 2007 refund is released.

If he's due a refund he won't get it unless he files. For 2006, the absolute last date is 4/15/2010.

He can order copies of the w-2s from the irs (form 4506-t). If you live in a state with an income tax, you need to contact the employer since the IRS doesn't track state withholding. Forms for 1990 to 2006 are also available at the web site. Print them out, fill them in, he signs, he mails.

All penalties and interest are based on the amount owed. If he owes $0, nada.

If he doesn't owe anything, even though he technically is required to file the IRS won't come after him if he doesn't. Of course he won't get his refund either if he doesn't file. If he files now, or even anytime in the next 2 years, he'll get his refund and not be penalized for filing late.

He will need his W-2's though.

He needs to get the W2 from the employers if possible. If unable to get them, go to an IRS office and talk with someone there. They are usually helpful when this happens. It is like someone making a mistake and trying to do the right thing.
