If you don't give them a W-4, they withhold tax at the highest rate available.
Actually, I'm surprised they are letting you work without this information.

Go to irs.gov. Get a W-4. Fill out and turn it in.
When you don't file the form they are supposed to assume SINGLE-0, which is the highest amount withheld. (Yes, this is very legal.)
When you file a new W-4, it takes effect the next pay period. (You will get any excess money back when you file your taxes.)
If you never gave them your ID/SSN, you are lucky they haven't been withholding 30% and telling you that you were fired. (This is what companies do when they find they hired an illegal alien.)

It's not only legal, but required. If you don't fill out a W-4 and give it to them, they are required to take out as if you'd filed single/zero allowances. Get the form to them, along with your social security card.
Technically they shouldn't be paying you at all until they see proper ID from you.

Sounds like the employer is more concerned about doing right by you than you are about doing right by them. Get a W-4 fill it out and be glad they did not fire you as without a ss number they are subject to IRS fines and have grounds to can you. If they have withheld extra, enjoy your refund and file a corrected form W-4 with them and forget about it.

I'm sure employers can treat you as single with one exemption in absence of you completing a W-4 form. If that is incorrect, why not simply provide the correct information to your employer?
