Hey how are you today. I am 19 years old and i recently dated a girl that is 16, we did not do anything at all....we just dated for a month. and i broke up with her, now i think she is really upset and jealous, so she told the cops that i sexually abused her so i got arrested for it and seen the judge, the judge just told me that i have ACD for 6 months and she has a order of protection agaist me, so i got i got out at 3:30 PM and i went out and see my godfather and came home at 10:00Pm and went to sleep, and at 12:00AM the cops showed up to my house and arrest me for Violation of order of protection so i went to jail again, They said i was in front of their house banging on the door and i threaten her, which i was home sleeping, so now i have court at jan 8 ,2007 and my legal aid told me that her witness is her mom and my witnes is my dad, and they have no proof that i was in her house threating her..so i am a little concern what would happen..thank you for your time reading this

well, the cops said before they arrested me that they seen the video of me and my car in front of her house...and the cops have checked my car engine and it was ice cold...but the cop still arrested me, i remember her telling me her uncle is a seargent in the PD, so i dont know whats going on...i was really home sleeping, i did not do it at all! but dont they need a proof to show the judge that i was there?

i did not violate the order of protection, i did not come near her and her house, i went to my godfathers house and came home, my dad seen me walked in the house...yes shes upset and jealous because i left her..

Sounds like your situation will depend alot on credibility, so whatever you can do to support your story and knock down hers will be important. Anything you can say or present that supports that you were home and asleep at the time that the violation was supposed to have happened.

Stuff like how you were dressed when you answered the door, what you watched on TV before going to bed. The more detail the better. Your dad's credibility will be important too, so he should be prepared to give as much detail as possible. Figure out when she says that you were there. Should your car still have been warm from running? Did the cops check on that?

You might do better if you had an attorney and it sounds like this is getting very serious.

Sounds like you need a good attorney & find out why the police are so quick to believe this girl and her Mom. Normally, in that situation, it is a misdemeanor and unless we see it occur, we file a report and request that the DA file charges, we don't go to someone's house and arrest them.

When you went to see your godfather did you go ANYWHERE near her or her home? Have you called, texted, IM'd, emailed, etc her at all????

You said they claimed you were banging on the door and threatening her, then you said they have no proof that you were in the house threatening her.....so which is it? Are you accused of being IN the house or just banging on the front door?

I guess you have learned your lesson about why not to break the 18 barrier.

But let's get serious. This child is upset with you for "breaking up with her" and the parents are buying the drama. I would sue the parents for defamation of character as soon as you get out of trouble, as long as you are telling the ABSOLUTE TRUTH that there wasn't a shred of sexual contact, you weren't leading her on and you guys just went to movies and other placid stuff. If this is true, you have a case.

Good luck either way. You're going to need some backbone to get out of this.

If you have a valid witness I don't see how you could be charged for violating pfa. Get your dad to go to court with you as a witness and also get signed affidaitt of neighbors whom seen your vehiclle in the driveway all evening. Get them notorized if witnesses can't go to court.If u were with anybody that evening get it documented your wearabouts..

That is one nutcase broad. Just tell the truth, if you have the bucks ask for her and you both to take a polygraph exam. Also, file charges on her for getting you arrested, it is a felony to file a false police report.

HOW IS YOUR DAD A WITNESS? YOU SAID YOU WERE AT GODFATHERS.? WHEN DID YOU LEAVE THERE? HE COULD BE AN ADDITIONAL WITNESS AS TO THE TIME FRAME THEY ARE SAYING YOU WERE SEEN AT HOUSE?

when you go to court plead innocent... say that you were not there... and ask to see the video of you banging on the door as proof that you were there

she sounds like she could be the next fatal attraction,,,,be careful of this girl she is out to destroy you, You need your own witnesses and proof you didnt do this

Get an attorney. NOT legal aid-- an attorney quickly. They are going to believe her (just being honest).
