His Father took him, but by Gods' mercy, I got him back. I had a warrant for assault and the sherriff picked him up, he let his Girlfriend with him, and she didn't want him and took him to his Grandmother. She called me to pick him up, only to set meup to jump me, and while I was in the driveway, he snuck out and got on the car with me. I have him, but am worried his Dad, who by law can, will come forhim. What can I do to stop this? Someone please help me!

You need to talk with a lawyer right now. Technically, you have kidnapped this child, but if the father has been doing things he shouldn't (like drugs), he may be afraid to turn you in and you should take advantage of that fact. Anyway, you need to get this corrected so that you are his legal guardian. What if he needed to go to the doc??
Does your daughter want him to be with you? If so, she should write a letter stating that fact.

Get a restraining order quick! I do hope you have filed a police report about the incident with the girlfriend (shows the caliber of people this man consorts with, and should not be allowed to have unsupervised visits with child. A court liason can be appointed should visitation be appropriated by the judge) Yes, always report ANY and ALL violence.

Then apply for a legal guardianship for your grandson. This should be a no-brainer for the judge. It can be costly if there is any fight. It is unfortunate that this wasn't done earlier, though I understand in the eyes of love and care- we shouldn't need a paper to give that! Today, we do.

There are MANY pro-bono lawyers who specialize in grandparent rights; especially in such circumstances! Many laws are published on the internet for each state and for federal as well. I also recommend you do a little homework as well - Google or Yahoo! search "state laws on grandparents rights custody" and such variations.

Oh my dear Brenda, I am so sorry that after being a very good and responsible Grandmother, you have to deal with this crap. Okay here is my plan, first, file a restraining Order against the so-called father, for yourself as well as your grandson, if the court will let you. Advise them that you fear for your life as well as the life of your grandson and take it from there (advise as to the effort to have you jumped and to cause you bodily harm) and please do this ASAP. Does the so-called father pay child support, is his name on the birth certificate, does he make regular visits, if any one of the answers is no, again, go to the courts and if you don't already have court appointed guardianship of your son, do so, again, ASAP. Depending on what state you reside, the laws are somewhat different, but in all, the best interest of the child will be taken into consideration. As far as a lawyer, if you can afford one, great, if not, see what you can do on your own, and should you need any help with the legal part of it, e-mail me and I will try my best to assist. Call a lawyer ASAP! The laws very from state to state on grandparents rights. The best thing to do is talk to a lawyer about the situations and get their legal advise. Sounds like this little boy needs you so try not to do anything that is going to get you in trouble b/c it won't help the situation. I wish you the best of luck!

Report the assault and call a lawyer ASAP! The father is violent and the child wants to be with you. You have a very good chance of getting custody of the child.

You need to contact your the police department about that incident and you need to get a lawyer and put a restraining order on him.

You then to also need to consult that lawyer and social services about getting sole custody of the grandson.

You do not need Yahoo Answers dear, YOU NEED AN ATTORNEY!! Go find one FAST and don't look back. Run to the court and try to get an emergency order saying you feel the child is in danger. You need legal help, not y/a help.

Well, why can't he live with his dad? Did he do something wrong? If not, by law his dad probably could take him. If he did to something bad,? I don't know if he tries to take him that's when you get the police involved. They will work it out. Anyway you can't just go to your son's house after nine years and say he's my kid get in the car.
