Legally: joint custody can be ordered. Richard is completely correct, but, think about what you are doing. IT can't be "undone", and, I, personally would worry about my child being taken into Mexico without my knowing. I think you are making a major mistake if you decide to do this.
Custody is legal custody... So, it will be shared by both parents (probably), but, I think you mean placement- that the child would be 50/50 shared. I think that is a mistake, also. This man doesn't know the child and isn't nice to you. You should want to retain physical placement of the child, but, allow "liberal visitation" or "visitation" to father. That way, dad can see him as often as possible, but, if he were to kidnap the child, there is no wait before it is considered kidnapping. Otherwise, if it is "shared" you will have to re-petition the court to get your son back.

Citizenship is irrelevant to custody issues. Family court won't even ask about his status.
The mother being a minor is an issue, but as long as she's in a stable home - say with her own parents - it shouldn't be a bar to her getting joint custody.

wow, that's a mess..... the answer to the actual question is yes, but the father not being a citizen is a curve ball... he still has rights to his child, but if the child was born in the us, then the child will not be able to go live in his country permanently unless that child gets citizenship.
This question makes me want to seal our boarders to everyone.
