heres the situation:
The husband was very abusive in the past and was already punished for that. now that they are getting divorced and the wife is scared can she file a restraining order based on those past experiences even after he was punished?
or does there have to be new allegations against the husband?

Was the punishment a previous restraining order...if so it would depend upon your state's law as to whether this was still in force. Otherwise, the answer would be generally, yes. See the court clerk's office in the county in which the victim resides for more info. They may have a website.

A restraining order is nothing more than a court order issued by a judge for a person to stay away from another person. That's it. You have to remember that if she acts crazy like you say and takes drugs like you say, then why should she listen to a judge. She's going to do whatever she wants to do. Some people think that restraining orders are some magical way to keep people away from them or stop them from hurting them. It's not like that. Restraining orders only work on sane, non drug abusing people who care what happens to them if they get caught violating the court order. Hope this help you in your decision.

Your friend needs to consult an attorney, but generally speaking she must demonstrate that her husband has said or done something that can be construed as imminently threatening her life or physical well-being.

Please don't guess about this. Consult an attorney (or even the local police if necessary) and act accordingly.

I think that there needs to be a better way to seperate them to MAKE SURE that they cannot be together if that is the case.

You see, if she were afriad, why would he obey the order?
